Thanks for the reply.But in my H1-B petition the DOB is correctly enetered.In my H1 stamping(Visa) the DOB is not correctly enetered.When i went to Driving licence office they checked my passport DOB and Stamped VISa DOB.and they asked me to get the DOB corrected in the Visa.one of my friend suggested me to goto INFOPASS and get it corrected.
Do u have any idea?

LCA(H1B) is for the Company and not for the Employee.
If you check your LCA your name will not be there anywhere.
It just gives
1.Location
2.Wage
3.Date.

Hi,
I have AOS and was recently laid off from my job. As I haven't found another job by the removal-from-payroll deadline, my H1B will expire. My question is, once I get my EAD, can I apply for a new H1B. The motivation is that I can bring a spouse over on a dependant visa only on H1B but not on AOS. How should I work this out?

Its not a problem. As long as your I-485 is applied and pending , you can apply any time.

This is a recent USCIS update announcing that any U.S. citizen seeking to adopt a Nepali child, whose case is not affected by the suspension of processing cases involving Nepali children claimed to have been found abandoned, should file the Form I-600 with the U.S. Embassy in Kathmandu.
This change in the filing location for the Form I-600 petitions applies to two groups of prospective adoptive parents who are not affected by the suspension. The first group is those who received a referral letter from the Government of Nepal�s Ministry of Women, Children and Social Welfare before Aug. 6, 2010, informing them of a proposed match of an abandoned child. The second group is those who seek to adopt Nepali children who were relinquished by known parent(s) and whose identity and relationship can be confirmed.
USCIS strongly encourages prospective adoptive parents to follow this procedure for their own benefit, based on growing concerns about unreliable documents, irregularities in the methods used to identify children for adoption in Nepal, and the resulting difficulties in classifying those children as orphans under U.S. immigration law. Republicans will only get on board if they see the proverbial crops rotting, buildings left unbuilt, and inflation picking up and all the beneficial effects of immigration dissipate. Thats what we are seeing now, stepped up enforcement to see if any of this happens. The arrest and deportation of that illegal immigrant who sought refuge in a Chicago church is as much real as symbolic of a shift in US Gov't policy.

CIS is bound by law to not accept early AOS applications. It depends on State published visa dates. So if we can work with State dept to have them publish the dates for Visa posts for CP as they do today (Which is faster) and add CIS processing delay to the Dates and publish second set of dates for AOS which always be atleast 2 years or more added to current dates published by State.
This gives chance to people, who missed their chance to file in AOS in 2007 July. They can atleast get benefits of AC21 in this tough economy.

- Copy of i485 receipt.
- EAD card front & back.
- 2 personal photos.

My husband has a pending I-130 visa petition (I am a US citizen, he's Italian, we live in Italy). Can anyone tell me whether he is permitted to enter (and exit, as we are still residents in Italy) the US on holiday (departure 19 dec)?

Sure. You need to work outside the US for the sponsoring company in a managerial capacity for 1 out of the 3 years prior to filing the I140. So if you are on a H1B and are a manager, you can sign up for an assignment abroad to fulfill that requirement.

Hi,
My lawyer says i can join company B as soon as USCIS has received my application for H1B transfer(by way of fedex tracking)? is this true or do we have to wait for receipt number/case number?
I need to know this because my company will not file I-485 until i join them but under the current backlog CSC is having a huge backlog with receipting H1B transfer cases.

Here is my case
I came to US in Aug 2005 on F1 and My I-94 was till Duration of study.
I graduated and my OPT was from April 27th 2008 till April 26th 2009
MY company applied for my H1 on April 1st 2009 and got it approved starting Oct 1st 2009 ...but i got I 797 B ( which does not have an I-94 and is H1 approval without change of status) instead of I 797A.
I 797 B is H1 approval without change of status, My employer applied for amendment on May 2009, but again i got I 797 B instead of corrected I 797 A with a start date of october 1st. Same thing happened 3 times and now i got I 797 B again and my company says that they are going to file for the change of status again but its already November and i dont know what to do.Wanted to know if somebody has gone through the same situations and If i go to India(Chennai) for stamping what would be the problem.
what should i answer if visa officer ask's me about what have you done from April 28th 2009 tilll October 2009 and as you were not in OPT or in H1b why did you stay in US...
