I am planning on accepting a full time position at client.I did not start with them yet. Client's lawyer is planning on applying for the PERM application and recruitment has already finished. My question is
Since I am yet to join the client, should the question in PERM application "Has the job been offered to foreign national " be set to Yes or No. Clients lawyer says we can leave it as "No"(Since I did not start with them yet) but chances of getting Denial because of this question are high. Should I join the client and then file for PERM or Is it OK to set it as "No" and hope it will get approved.I am planning on joining the client in couple of months.

On this case, I am getting mixed anwsers
Employer's lawyer is saying that i can continue to work since have valid I-94 and they are going to appeal. Lawyer called USCIS officers and USCIS officers confirmed this ( !!!).
Second lawyer is saying that i should stop working on denied petition.
Once you apply for appeal or motion your H1B peition status changed from 'Denied' to 'Pending' and you may continue to work for employer. - this is my guess
In fact, I am planning to get advice from murhty too...
Any thoughts on this.

Your I - 94 Validity cannot be at a date later than H1-B. You say you got your first H1B visa till Oct 2005, but I - 94 expires in Nov 2005. I donot think it can happen
Third country Nationals can go to Mexico and get thier Visa stamped. The only thing is if your Visa gets refused for some reason, you will have to fly back to home coutry and get it stamped.
Have not heard such cases though.

Hi,
Myself and my wife applied for 485, 765 and 131 on Aug 13th and we got receipt notices on Oct 5th.
But we got only 485 & 131 for my wife and i got 765 and 131.
485 Receipt is missing for me and 765 is missing for my wife.
We haven't got any mail today also i.e. Oct 6th. Any thing similar happened to anyone?
When we will get other receipts. If at all they are missing can we contact USCIS to send them again?

Bob is right. Don't buy anything from any camera shop in Brooklyn. Those package deals are not deals at all. They are a huge scam designed to steal your hard earned $ and leave you so frustrated at their total lack of customer service that you give up. If the price of any equipment is considerably less than B&H, Amazon, Adorama, or J&R, stay away. The stuff you'll get in that package will not be what you think it is. In response to my service request on 9th Sept 2009, my I485 has been transferred to the USCIS Hialeah Florida office for further processing. Normally I -485 cases are forwarded to local offices for the purposes of scheduling an in-person interview. In my case I live in New York and no way connected to FL. I am curious anybody or any of your friend�s have similar experience.

The bassist was reeeeealy close to a bright yellow-ish light everytime it came on (hit his arm and bass) it blew everything all to hell. Not quite sure how to compensate for something like that so I started taking shots when that one light turned off.
I was using a flash with a different band but from a distance. I wasn't too sure if it would bother them or not.

Hi all, I hope someone can provide me with some advice.
I made an awful mistake today. I am in the middle of an H1-B transfer (company just signed application and sent to lawyer for sending to uscis this week) and moving to a different city for this job. I am moving this week and will commute to my old job until my notice gets accepted. My issue:
I had prepared my AR-11 (change of address form) and had it sitting on my desk ready to be mailed once my application was approved (since my application and all documents had my old address from when they started the process). I took the envelope with other mail by mistake today and put it in the mail.
Will this be an issue with the application? I don't know if they'll deny my transfer because of an address discrepancy or something.
Please advise.

I believe that you can travel to India - no need to worry. You can use your AP while returning - and it will work even if your GC has been approved. I personally saw this working for my friend couple of years back. He and his wife travelled to India - I was checking their mails for them. I received their GC while they were in India. They didn't have any problems in returning using AP.
I would also ask an immigration lawyer to double-check. All the best.

I am wondering about this because my I-485 has been filed in Texax Service Center and the receipting date is still way behind. I live in Minnesota and I need to ask my lawyer why did they file my application in TSC instead of NSC. Is there a choice about which Service Center to file applications in? Is there a possible rejection because my application could have been filed in NSC but is filed in TSC now?

I have just signed a contract to buy a new home.
The first step is to be eligible for mortgage.

I tried explaining her that I was not on H1 and had not received GC yet, that I am on EAD.
But she did not understand it. She only understands H1 or GreenCard.
I am not on H1 since I changed my employer and it expires this October.

First, your friends father needs to find an employer who is willing to sponsor him for H1B and later for GC. Usually, all legitimate employers will have a host of immigration lawyers and counselors who will take care of things from that time onwards.
That said - now may not be the best time to try and find a job in US. Finding a H1B job (i.e. one that cant be filled locally) - is even more of a challange. I wish him best of luck.
If the person has relatives in US (is your "friend" a US citizen?) - then he may be able to "quickly" (1/2 years for immidiate relative, much more for others) immigrate using the family based immigration.
