My am in eb-3 category with a PD jan 2007.
I applied my i-485 to NSC and it was transferred to NBC in 2009.
NBC arranged an interview with the local immigration office in April 2009.
The Immigration Offer issued a welcome notice even though my PD was not current.
I still have not received the GREEN CARD.
In March of 2011 I received an email saying that my case has been transferred to TSC "to speed up processing"
So I dont know if this is a good thing or a bad thing.
Please respond.

I think your first point is valid. I would do the same thing. If you are using AP, I don't think you need to go for stamping.
Your second point is some what complicated. As your H1 is expiring in April, if you renew it later in July, it might go for consular processing, which means that you won't get the I 94 with the approval notice. In that case you need to reenter uisng a valid visa.

both of us are physicians working on h1b visas .we have ead's.i want to do a fellowship.i believe i cannot do a fellowship using my ead.can i use my wife's ead,showing myself as a dependant?all help from the gurus will be greatly appreciated.thanks.
EAD is employment authorization document. Your analogy is like -
"Can I use her driving licence to drive around town". I am not sure if that is what you meant.
If you want her to be the primary applicant in your GC application and then use EAD as a dependent, that is possible. You will lose your H1B status then.

I concurrently filed both my I-140 and I-485 back in Oct 09. My I-140 was approved on March 18th and then nothing since. I read that by concurrent filing the process is quicker. I am on an EB1-C. My question is has anyone had any experience in the time frame for concurrent filing under the category i am under? I have checked the tracker and cannot see anyone in similar position. Time line is what i am looking for or is it a "wait and see" situation?

Please provide us more information. If you are working as a manager in IT and especially from Indian companies, USCIS is investigating the EB1C cases as there is rampant corruption and manipulation. I am not sure what you mean by EB1-C - is it china or EB1C.

I think what they are saying is that after 150 days and no FBI clearance, then they are introducting an additional request and FBI will direct USCIS whether to approve the case even without clearance.
If all these communications back and forth happens in a timely manner then it may not be too bad.
Note:They are saying that most of the FBI name checks are being processed within 90 days.
Hopefully this is not going to be a major issue.

Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??

If this is true then some of the concurrent filers will try to upgrade them to PP.I will be surprised if they do that. But crazier things have happened.
I really doubt it, with all the current workload, USCIS can't take I-140 PP. That will further slow down the receipts.They have enough work for this year. Providing receipts, EAD, AP etc for more than 100,000 applicants.

This is strange and I don't know if anyone has come across this situation. My I-140 is under appeal process from last 5 months and today I got this update on my I-485 that "my case has been sent to ADMIN APPEALS OFFICE location for processing ". There is no update in I-140 or I-290B forms date online. Does anyone come across same situation then please share with us. :confused:

I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following
1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.
How to get court deposition or evidence that no charge are filed against this arrest?
I have filed petition for expunging arrest record but that will take a while to conclude.
Please advice what proof I can send to USCIS that this arrest did not even result in charges in court.

My home country is India. can i Go back to india and apply for L1 B again. or can i just cross the border and come back in usa (so that my i-94 get extended).

My wife last time entered to US with H4 in June 2010. Then she applied for F1 status and got approved in Nov 2010.

u can retain PD only if u have Labor and I140 approved from Old Company.
When u file I-140 with new company - u dislcose intent to retain old PD as u submit copy of approved I-140 (u got with old Comapny)

It was a mistake by the guy who stamped I-94 (at CBP).
Her H-4 must be expire on your expiration date.
You need to go to nearest CBP office to get it corrected.
She need deferred inspection to get it straight. USCIS will not do it.
OR Do nothing about it and file H-4 extension along with your H1B extension.
If you do not extend her with your petition, even if she have valid I-94, she may end up in trouble later.

Please do not rely on Indian Media for immigration news.
They have covered their bases by putting "May" in the headline. "May" increase visas.
There is already a discussion that happened about this on another thread. Please search the forums for the article before starting a new thread.
And for heaven's sake, please dont look for immigration related news in Indian Newspapers. They dont know that congress has two chambers : House and Senate. And they dont know the common basics of legislative process in USA.
