We should get a group of folks asking for reinstatement of I-140 premium processing. This SINGLE administrative move will enable high skilled workers on many counts. Legal interfiling cases can be expedited, and non interfilers can be one step closer to getting their I-485's with EAD cards should there be future retrogression.
Also, the reality of revenue gained from premium processing cannot be ignored. Ok, dont keep it at 15 days, make is 30 or even 45 days. But dont take it away in its entirety.
I would sincerely request even EB2's that have current dates to join in requesting I-140 premium processing. This should not negatively intersect with any of your interests.

I just found out that I have an employment gap of 11 months working without authorization. I applied for an I-485 in 2007 (I-140 approved) and my paralegal told me I didn't need to renew my H-1 nor apply for EA, I was covered by the pending I-485. Today I got a RFE requesting proof of authorization to work since my h-1 expired, and realized I couldn't be working when I hired a real lawyer to take care of this case and she informed me so. How to respond my RFE??? Would they forgive 11 months of working without permit because of bad advice? I have a 9 year history of keeping my papers legal and up to date until this incident. Please help!
Did you apply for I-765 (EAD card) along with your I-485 application. If you did, that could be the posible reason why the paralegal recommended you for not applying extension of H1. Try to find out if you have a valid EAD card and that should help to reply the RFE. If not, try to check if you have a valid I-131 (advance parole). Just drive to Canada and fly back in, using AP, and say that you were not even here for last many years ;-) How about that?

Firstly, congrats!! BTW, when did you get the fingerprinting completed in your case? Want to get an idea as to how fast the whole process was done. Lets hope it is this way when our turn comes ;)

The maximum duration of a J-1 is 7 years but the visa is issued 1 year at a time (royal pain). Therefore there is nothing such as a transfer. When residency is over, if you get a fellowship the program files with ECFMG the necessary papers to prove that it's an accredited program etc It is ECFMG that sponsors you not your program/hospital. Each year the program informs ECFMG on your progress and based on that a new sponsorship for another year is granted.
After my first fellowship i was board certified. In order to specialize further I (and my new department) had to convince ECFMG that there was some merit in the whole proposal. anyway long story, they did sponsor me and I did another 2 years thus completing the entire 7 year period.
As for GC, my employer just started the process and insisted on choosing an expensive corporate lawyer they have worked with before. She is in no hurry and I don't know when I will even have a priority date let alone a GC. This is after 11 years here. such fun....

msp1976, I found out that it would take at least a month to get a new passport (is this right?), and I did not have time for it. I'll be sure to post my experience here.

I have heard of people getting passport in 1 day or so in New York...But you have to go in person.....The mail service would take longer....
Also once they give you a stanp for the whole duration.. as someone mentioned earlier...you need to carry the old passport and the new booklet they give you...That works out just fine.....
About what happnes at the POE depneds on the USCIS officer....It is just a draw of luck..

Since you are/were on h4 you are a beneficiary. Only the primary applicant has to
work in the field in which his/her labor was filed, that too untill one gets the green card.

Yeah, usually people look for credentials when finding a web designer.
You know what you could try to do?
Possibly create so mock sites to add to your portfolio to show people who are looking.
Like they don't have to be for a real company, make something up, build a site and use that to show people.

it sounds like PD is a MUST for approval but for actual processing order , as in backlog queue, it seems purely by luck :(

The I-140 processing date for EB2 Nebraska is June 2007. I have a friend with receipt dt on July 30, 2007 in EB2 whose I-140 was approved today. My I-140
was received on July 2 , 2007 and is not approved yet.

I can work in the Software company fulltime but at the same time can work in a motel part time, now when I get lay off from the software company ..I'll be in status but working for motel, also not full filling the condition of Highly skilled labor etc.
Can someone please explain all this. So far I know you cannot have this and this is what my attorney told me when I thought of doing that to open up a company and work as an employee partitme in it.
