Does anyone have any experience how long it takes to get the Canadian visa if my family members who are visiting were to travel to the Canadian Consulate in Seattle.
Earlier you used to get on the same day (in matter of hours), but apparently in March of this year, they changed their policy. "Minimum 24 hours" is not a very helpful indicator for planning :(

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. Myself(Husband) & mywife both came on H1B from same employer.
My son got H4 visa through my wife H1B visa.
I (Husband) applied for green card and got EAD for myself & mywife , got Advance parole for myself, mywife & myson and are in 485 pending AOS status,
My Wife is taking permanent job with EAD (EAD is through my Greencard process)
If employer cancels my wife H1B she will come to EAD status.
I am not sure what will be the status of my son who is currently on H4 visa through my wife H1B visa.
My son got Advance Parole and 485 pending status through my green card.
Do I need to apply for H4 visa for my son or will my son be ok on pending AOS status ?

I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports? Response from anyone with experience will be appreciated. If already discussed here, guidance to particular forum will help.
I have traveled by Emirates several times (last year was the recent one) and they did NOT require a transit visa.

It is very possible that my question might have already been answered in the past but after searching through many forums, I could not find a direct answer.
Here�s my situation:
Category: EB2
PERM approved.
I 140 approved.
PD � Dec 2007.
H1-B status: 6 yrs expiring Sep 10. Filed for 3 yr extension.
I have an excellent chance of a promotion to a managerial level position. I am seriously considering abandoning my current GC process, accept the managerial position and reapplying for a new H1-B and GC.
Questions:
1. Will I need a new H1-B? If so, for how many years will I get it?
2. When I apply for a new PERM, will PD of Dec 2007 still be valid?

1. You will need a new H1-B with a new LCA appropriate duties and responsibilities, wages etc.
2. Yes. You can retain the old PD with the I-140. Take care to note that that you are not applying for the PERM but your company will be and your company may or may not find qualified citizens/permanent residents. You do not and should not control the recruitment process.

You can find noraties always at the nearest "Mailboxes Etc".. in the town; they are pricey though at $ 10 per attestation, else you should check your legal department in your work place.

My wife did call the National Customer Service Center and opened a service request too. But we have not heard anything yet. We tried getting an infopass appointment but none is available in our area. We will try it again tomorrow. I am kind of surprised how this can happen because in the USCIS database, approval of derivative application requires a check on primary application approval first. This is what I have been told by another lawyer.

well if there's a way for you to get your approved labor certification doc, or even the copy of the filed labor application; then definitely get it.
The labor app has the exact job description too. So if you do use portability (ac-21) it'll help to match it with the job specs of the new position.

The House of Representatives on Saturday night passed a sweeping health care bill by a vote of 220-215. In the next few weeks, this bill will be analyzed and there will be various summaries online regarding this important piece of legislation. I would like to focus on the Immigration related matters in the Bill.
The Congressional Hispanic Caucus staunchly oppose including a provision that would bar undocumented workers from using their own money to buy health insurance policies available through the exchange.
The measure is already included in the Senate Finance Committee's version of the bill and is backed by the White House. Some conservative House Democrats have also indicated their support for the Senate language.
Several Hispanic Caucus members who discussed the issue with House Speaker Nancy Pelosi on Friday said they had received assurances the Senate language would not be included. Rep. Charlie Gonzalez, D-Texas, warned Thursday that several caucus members might try to block the House bill if it's changed to conform to the Senate measure. Pelosi's bill includes various requirements for immigrants to verify their citizenship before getting federal subsidies to buy health insurance. Conservatives, however, have called the requirements insufficient.
We will review the Bill and report on more important points that will be of interest to Immigrants.

My attorney submitted my I485/EAD/AP last July 20th, the USCIS in Nebraska received it on July 23 by R. Pitcher at 9.29 am, since then I have no information on checks, LUD or receipts.
I reviewed all the information sbmitted by my attorney and I fond that she sent my paperwork using FEdex to:
U.S. Citizenship and Immigration
Nebraska Service Center
850 S Street
PO Box 87845
Lincoln, NE
US 68508
After taking a look to the USCIS site the address is correct but she missed the PO BOX numbers and wrote 87485 do you think this is a problem, please advise guys. what can I do

My new employer doesn't sponsors/transfers H1B visa. And my priority date is Dec 04 EB3 so I don't think that I would be getting my GC in near future!
As per the job I know this one is the safest since the new employer has never ever laid off employees in its entire history. So, I'm not worried about the job security, only thing which scares me is that if there is some problem in my I-485 and I get a denial whether I would be able to switch back to H1B?
Worst case scenario my wife has a valid H1B and I can switch to H4 and probably wind up the things here :-)

Hi All,
My LC was approved recently(PD June 2004). The location/office for which my LC was initially filed was closed recently.
My company(which has offices all over states) has another locations/Offices in the same metropolitan area.The company attorney is saying that they can use my approved LC to file my I-140(and I-485 concurrently) for another location in the same area as long as it is within commuting distance of the original location.
Was wondering if anyone knows about this?
