USCIS had been given strict guidelines to process all cases within a six month timeframe depending on the type of the case. But many cases have come to light which are not seeing the light of the day.
How about filing our taxes on April 16, but not on April 15.
What is the relationship between the above two? You will get your return back if its postmarked past the deadline.

guys,
have u seen the legal immigration/ foriegn workers issue address by Bush today. althou he spoke just 1-2 sentences. stating that ' legal immigration system needs to be fixed, so that foriegn workers are in no harm

I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.

My wife was in US in Oct 2007 on H4 Visa and went back in Mar '08 while she was in US we applied her H1B in 2008 and was approved and she got her H1B stamped in India and came back to US in Oct 2008. since she did not find any job, her payroll is not running and the her employer wants her to switch back to H4 Visa, and once she finds a project she can change her status back to H1B.
My Question here is
1) For COS from H1B to H4, Does she need Pay stubs? and how easy it is for the COS?
2) Her Employer says that she can apply for H4 Stamping and inform the Visa Officer that during her stay in US she did not join the company for medical reasons. Does this create any issues with her H1B.
3) Can Some one suggest a good immigration Lawyer in San Diego?

Wow, very interesting. Though I might experiment with cropping (first try would be cutting off the bottom, including the one bird down there, to make it more panoramic and [hopefully] make the horizon less centered), there's not really anything that I'd change about this photo. Good work, IMHO. :)

Yes there is. You need to write to the Service Center that has your I-485 and ask that the approved I-140 with the earlier priority date be substituted for the one in your 485 file.

Just make the switch,,thats it! Its that simple!! Make sure when u join the new company they file your perm asap and when u r in the 140 stage, you could work with your lawyer to port your old PD. AC21 has made life better!

b) Wait for your I-140 to be approved. Once it is there, move on, and file your PERM/I-140. You should be able to get your next extension based on the approved I-140 unless it is revoked. Also, you can start your PERM in parallel while waiting for I-140. You can speed up your I-140 by moving it to PREMIUM processing - it involves another 1000 $ of cost. This way you can carry on your PD if you can get a copy of the I-140 when you leave.
There would be other ways too - folks here can enlighten you on the same and if there are any corrections in what I suggested you, they would gladly do it.

I have question for you. How many APs we have to show at POE? One of my friends, he came from Canada, at POE they took 2 APs. They stamped on both of them. One they took and one they gave back to him with stamp.
As of I know. We need to give 1 AP at POE. Is this true?

So are these different from the finger prints that we take for EAD? For people who got their priority date current, do they ask for a separate finger prints again? Does anyone can shed some light on this?

yes. AC21 is a provision to allow you to change employers without affecting ur 485. It has nothing to do with work authorization. Your authorization can come from ead or h1 transfer.

I agree with you that you need to go with lawyers who are really specialized in immigration especially when the case is complicated.
I know a person whos company lawyer screwed up the case. (They are from a very reputed law firm). Then she went with Murthy, they did a great job and got it done for her. They charged her a lot but it was worth it.
So get the best out there. It may be expensive but if it fixes your case its worth it.

SO I have a question. I received my 45 day letter way back in Jan 2006. As of today, no action has been taken on my application. I have recentlly acquired the help of my congressmen to find out what the hold up is. I am waiting since Oct 2001.
I have done a PERM and it has been approved, my I140 has been approved and now waiting for dates to become available. Here is my status as of yet.
I am in my 8th year of h1. I will be applying for extention of my 9th year within a couple of months. I will use my I140 to get 3 years extension. SUppose my old labor is up, can I use my Perm advertisement for that. The job oppourtunity was same for PERM as it is for old labor. Will it be different advertisemtn. Those who have go that labors approved, what kind of advertisement does the DOL requires when its NON RIR. How long does that usually take.
My company might be getting sold in the near future. So there is a possibility that I will loose my job. what are my options then. I only have 5 monts left on my 8th year H1b visa. Suppoe my extension is approved for 3 years base of my I140, before the company is sold. Can I transfer my H1b visa toanother compnay. what if it is in a different state.
Can congressional inquiry help the process speed up a little bit.
Anyone who has gone through this, your response will be appreciated.

Remember to point it out at FP, and they will also ask you to phone USCIS and correct it. You could phone USCIS first, and then you might find that FP has it already corrected in the computer.
Once USCIS update it they will send you a letter to say that they made a change to the file, this is just FYI.
My wife's DoB had a typo. It was spotted at FP office.
Of course I am assuming some obvious typo, not a FP notice for Jim Smith and your name is Ramkrishnan Singh. :-)

Here's an example of my first outing with my new lens, shooting birds in a nature preserve bird feeder area. I used a monopod on a cloudy day. I didn't realize how quick those little buggers can be. I shot manual and found the autofocus to be irritating at times. Any feedback on doing this kind of shooting would be appreciated.

Can anybody please let me know what are the documents needed to file for 485. If I do not have any immunization record, how can I show that immunization record?

We are going to demand TRANSPARENCY in addition to efficiency for BECs. Its a part of Immigration voice's agenda.
Is there ANY mechanism right now for applicants or their attorneys to find out what's going on with their PERM application? Is there a phone number you can call or an email address you can write to? It seems that at a minimum the processing centers should issue a monthly report on the progress and issues encountered.

One of my friend is in the same situation and he has been told by his lawyer that he can get his part-time concurrent H1 Extn for 3 years based on fulltime concurrent H1 approved I-140.
He is going to apply the same soon.
