Yes, I realize a H1 transfer is needed to work in another company. And 140 is not approved. So the new company has to start GC all over. Too bad, it looks like priority date cannot be ported since it LC is still in process.

anyways, your 485 was filed last month, kind of sucks, bcos you can invoke AC21 if your 140 is approved (in your case it is), 485 >180 days, find a similar job with more or exact pay mentioned in your LCA..Use your EAD and lose your H1 status ( could be risky if your AOS is denied, then you do not have a status).
In other case, you need to find a company which can sponsor (transfer your H1) and then start your perm all over again.
Other senior posters, pls shed some light on this topic. Is AC21 safe ? what is the probabilty of getting GC through AC21 without an RFE?

Hi,
I am working in company 'A' on H1B, Green card is processing from company 'B' as future employee. Got EAD.
The job is getting over from Company 'A'.
Can I use my EAD and can stay in US with out working to any company?
Will there be any issues if TAX is not paid when I am not working.
If i work part time then on do I need to work for company 'B' only?

You actually were out of status since Dec 30 till this moment and you still are out of status. You are immediately out of status once you are not paid for the job or fired, regardless of the fact if employer revokes H-1 or not.
You can not do H-1 transfer any more. Your next H-1 petition will be a new petition but you will not be subject to H-1 cap as you already have been counted for 6 years.
So I presume it would safe to get a job offer and leave as soon as possible, then wait for the H-1 petition get approved, stamp H-1 visa and get back.

I just graduated with a Bachelor Degree, and I am currently on H1B. I am so concerned about the 5 year backlog on EB-3, which will take more 10+ years to become a citizen....
I am thinking about getting an online MBA degree from an accredited school ASAP, and ask my employer to promote me to a position that require an MBA, ex. manager. (I think it's not a problem in a small company) Will I be able to get into the EB-2 line?
Have anyone done that before? May you share your experience whether it's successful or not?

I am in a bit of confusion and needed some info. I had applied for I-485 during July fiasco and my spouse applied as derivative. We had applied for her H1 extension/transfer through another employer after we filed for I-485 as we did not want her to use EAD. We recently received her H-1 approval without I-94.
I am not sure at this point if she has to leave immediately to get the h1 stamp Or she can continue to stay here as her AOS is pending based on derivative status of my application.
Also will her getting approved without I-94 impact her pending AOS in anyway

You can stay out of the US for up to 6 months with no consequence, as long as the person has a vaild green card and passport. Over 6 months contact with the US consulate is needed and the green card holder can stay out of the country for up to a year. Over a year the green card holder will forfeit their green card and not be allowed to re-enter the country.
The US permanent resident CAN stay out of the country for more than a year if they apply for and are granted a re-entry permit by USCIS prior to leaving the country. My labor got approved couple days ago and my employer would like to file I-140 without using an attorney. I have few questions, it might seem simple to you but I am confused:
I am a software engineer and labor approved for SOC 15-1032, what should be filled in the nontechnical description of job field? For H1B, my company listed duties of the position on the cover letter for this question, should it be the same way for I-140?
Anyone has sample template of the cover letter?
My company has not filed tax returns for the last quarter, will the returns of second last quarter do? I have W-2 which is substantially higher than the proffered wage.
Since I am earning more than the proffered wage should that be filled under "wages" on I-140 or the offered wage mentioned on perm?

i have a 485 filing question. i'm on EB2, ready to file for 485. however, i am in india on a family matter and will have to return only for the filing. i know it is "sooner the better", but i am trying to figure out how late i can return to US.
i have read on this forum that dates will retrogress in august. any informed people out there know how likely that is?
also, if i have to make it there in july to file 485, any idea about how long after filing i need to stay in the US before i can return back to india? i mean, any rules which say you cannot travel before such-and-such happens?
